MANILA, Philippines – Former Police Staff Sergeant Jonel Nuezca is facing P70 million restitution for damages from the family of Sonia and Frank Gregorio.
Atty. Freddie Villamor, the legal counsel of the Gregorio family gave an update of the case on Raffy Tulfo's show. He confirmed that the bereaved husband of Sonia, Florentino Gregorio will be presented as a witness against Nuezca. According to Atty. Villamor, considering the civil liability, they are looking at more than P70 million in damages.
"Thru him, in-establish po natin ang civil liability ng akusado at nanghihingi po siya ng total amount of more than PHP70 million," he said.
Atty Villamor further explained, "To breakdown, nanghingi po siya ng PHP20 million that is PHP10 million each, for each victim. Tapos nanghingi rin siya ng PHP50 million for exemplary damages para huwag tularan ang ginawa ng akusado sa pagpatay sa kanyang asawa't anak."
Aside from that, the court will also compute the compensatory damages. Under the law, the civil indemnity for every deceased or every victim is P75,000, Atty. Villamor said.
"Kaya more than PHP70 million po ang total damages na hinihingi ng private complainant," he added.
The legal counsel, however, clarified that the amount is still up for approval of the court.
Nuezca was caught on video shooting Sonia and her son Frank pointblank during a heated altercation in December. He has recently been dismissed from police service. The former cop pleads “not guilty” during his arraignment for two murder charges last January 7 at the Paniqui Regional Trial Court Branch 67.
While Florentino is already considered to be the private prosecution's first witness to prove Nuezca’s civil liability, they still have seven witnesses that are willing to testify against Nuezca.
Earlier, Iligan City Rep. Frederick Siao, who serves as the vice chairperson of the House committee on public order and safety, told the government prosecutors to prepare that the defense legal counsel would pull up an "insanity defense" for Nuezca.
"Nuezca’s lawyers will try to put forward the insanity defense. They will try to convince the public that Nuezca ‘lost his mind,’ had a ‘psychotic episode,’ or ‘nagdilim ang paningin’ moments before he shot in the head and instantly killed Sonya Gregorio and Frank Gregorio,” Siao said in a statement.
